Terms of Use for Genius Helper

These Terms of Use ("Terms") govern your use of the Genius Helper Alexa skill ("the Service"), provided by Fontaine Farm SRL ("Company", "we", "us"). By enabling and using this skill, you agree to be bound by these Terms. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Genius Helper is an Amazon Alexa skill that provides AI-powered responses to user questions using Azure OpenAI's ChatGPT model language model. The Service is designed for informational and entertainment purposes and maintains conversation context within each session.

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. This license does not include the right to:

• Modify, reverse engineer, or create derivative works of the Service
• Use the Service for any commercial purpose without our written permission
• Attempt to gain unauthorized access to the Service or its systems
• Use automated systems or software to extract data from the Service

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable law or regulation
• Transmit any harmful, offensive, defamatory, or illegal content through the Service
• Attempt to interfere with or disrupt the Service or its servers
• Use the Service to harass, abuse, or harm another person
• Impersonate any person or entity or misrepresent your affiliation

5. AI-Generated Content Disclaimer

IMPORTANT: All responses provided by this skill are generated by artificial intelligence and may contain:

• Errors, inaccuracies, or incomplete information
• Outdated facts (AI model has a knowledge cutoff date)
• Biased or inappropriate content despite our best efforts
• Hallucinations or fabricated information presented as fact

You acknowledge and agree that:

• The Service is NOT a substitute for professional advice
• You should verify all important information from authoritative sources
• You use the Service entirely at your own risk
• We are not responsible for decisions made based on AI-generated responses

6. No Professional Advice

• Loss of profits, revenues, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Damages resulting from any content obtained through the Service
• Damages resulting from unauthorized access to or alteration of your data
• Damages resulting from any AI-generated content or advice

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED €100 (ONE HUNDRED EUROS).

9. Indemnification

You agree to indemnify, defend, and hold harmless Fontaine Farm SRL, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations

10. Intellectual Property

The Service and its original content, features, and functionality are owned by Fontaine Farm SRL and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Genius Helper name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Fontaine Farm SRL. You may not use such marks without our prior written permission.

11. Third-Party Services

The Service relies on third-party services including:

• Amazon Alexa: Subject to Amazon's Terms of Use and Privacy Policy
• Azure OpenAI: Subject to Microsoft's Terms of Service and Privacy Policy
• Vercel: Subject to Vercel's Terms of Service

Your use of the Service is also subject to the terms and policies of these third-party providers. We are not responsible for the actions, content, or policies of third-party services.

12. Modifications to Service

We reserve the right to:

• Modify, suspend, or discontinue the Service (or any part thereof) at any time
• Change features, functionality, or availability of the Service
• Impose limits on certain features or restrict access to parts of the Service

We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

13. Changes to Terms

We may revise and update these Terms from time to time at our sole discretion. The "Effective Date" at the top of this page indicates when these Terms were last updated. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of applicable laws or regulations
• Fraudulent, abusive, or illegal activity
• At our sole discretion for any other reason

Upon termination, your right to use the Service will immediately cease. You may also disable the skill at any time through the Alexa app.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.

Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Brussels, Belgium, where Fontaine Farm SRL is established.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

18. Entire Agreement

These Terms constitute the entire agreement between you and Fontaine Farm SRL regarding the Service and supersede all prior agreements and understandings, whether written or oral.
